TorGo — Terms of Service
1. Who we are
TorGo ("TorGo", "we", "us") is an online appointment-booking service operated by Sprezza LLC, a limited liability company organized under the laws of the State of Illinois, USA. You can reach us at support@torgoapp.com.
These Terms of Service ("Terms") are a binding agreement between Sprezza LLC and anyone who uses TorGo. By creating an account, making a booking, or otherwise using the service, you accept these Terms and our Privacy Policy.
2. What TorGo is (and is not)
TorGo is a scheduling platform. Salons, barbershops and similar businesses ("Salons") use it to publish their services and working hours and to receive bookings through a shareable link. People who book appointments ("Customers") do so directly with the Salon.
- Each Salon is an independent business. We are not a party to any appointment, and we are not responsible for the services a Salon provides, their quality, pricing, availability, safety, or legality.
- TorGo does not process payments between Customers and Salons. Customers pay the Salon directly at their appointment.
- Any dispute about an appointment or a service is between the Customer and the Salon.
3. Salon accounts
- You must be at least 18 years old and able to form a binding contract.
- You must provide accurate information about yourself and your business and keep it up to date.
- Your account is accessed with your phone number and one-time codes. You are responsible for keeping your phone and login access secure and for all activity under your account.
- One account per business; you may not sell, transfer or share your account.
4. Plans, fees and billing
- TorGo offers a Basic plan (₪99/month, for a single practitioner) and a Pro plan (₪179/month, with team features). Current pricing and plan contents are shown on our website and may be updated as described below.
- Free first month. New Salons get their first month free. A valid payment card is collected at signup; nothing is charged until the free month ends.
- Subscriptions renew monthly and automatically until canceled. Payments are processed by Stripe; we do not store your full card details. Stripe's own terms and privacy policy apply to payment processing.
- Unless stated otherwise, fees are exclusive of any applicable taxes, which are your responsibility.
- Cancellation and refunds. You can cancel anytime. Cancellation takes effect at the end of your current billing period; you keep access until then. Fees already paid are non-refundable, except where a refund is required by law.
- Price changes.We may change prices with at least 30 days' notice (via the service or the contact details on your account). Continued use after the change takes effect means you accept the new price.
- If a payment fails and is not resolved within a reasonable time, we may downgrade or suspend your account.
- You may switch between plans at any time. Downgrading to Basic requires reducing your team to a single practitioner and disables Pro features.
5. Booking Customers
- Customers do not need an account. Booking requires a name and phone number.
- Each booking confirmation includes a private link to manage (cancel or reschedule) that booking. Anyone with the link can manage the booking, so don't share it.
- Salons set their own cancellation and no-show expectations; please honor your appointments or cancel through your booking link.
6. Messaging, and the Salon's responsibilities for it
TorGo sends messages (via WhatsApp when available) of two kinds: transactional messages (booking confirmations, reminders, changes and cancellations) and marketing messages (rebooking suggestions and broadcasts) that Salons send to their own customers through TorGo.
- If you are a Salon, you are responsible for your marketing.You confirm that you have the recipients' consent required by applicable law — including Section 30A of the Israeli Communications (Telecommunications and Broadcasting) Law, 5742-1982 (the "Spam Law") — before sending marketing messages through TorGo.
- Every marketing message sent through TorGo carries an unsubscribe link. Opt-outs are honored automatically and permanently; you must not attempt to circumvent them or contact opted-out recipients through TorGo.
- You may not use TorGo's messaging for content that is unlawful, deceptive, harassing or unrelated to your business.
- We may throttle, limit or suspend messaging (or your account) if we reasonably believe it is being misused, generating complaints, or putting our messaging channels at risk.
7. Customer data: your list, our processing
The customer details collected through your booking page (names, phone numbers, appointment history, notes you add) are your customer database: for the purposes of the Israeli Protection of Privacy Law, 5741-1981, the Salon is the owner/controller of that data and Sprezza LLC processes it on the Salon's behalf. As your processor, we:
- process your customer data only to provide and improve the service for you;
- do not use your customer list to market our own or third parties' products;
- protect it with measures consistent with the Israeli Privacy Protection (Data Security) Regulations, 5777-2017;
- engage only reputable sub-processors (such as hosting and messaging providers) bound by confidentiality and security obligations; and
- delete or return your customer data after account closure, subject to the retention periods in our Privacy Policy.
As the data owner, the Salon is responsible for having a lawful basis to collect and use its customers' details and for responding to its customers' privacy requests (we'll help with the technical side).
8. Acceptable use
You may not use TorGo to:
- break any law or infringe anyone's rights;
- send spam or unsolicited marketing;
- upload content that is unlawful, deceptive, defamatory or infringing (including logos or photos you don't own);
- probe, disrupt, overload or reverse-engineer the service, or access it by automated means except through interfaces we provide;
- misrepresent your identity or your business; or
- resell or white-label the service without our written agreement.
9. Content and intellectual property
- TorGo, including its software, design and branding, belongs to Sprezza LLC or its licensors. These Terms don't give you any rights in it beyond using the service.
- Content you upload (such as your logo and photos) remains yours. You grant us a non-exclusive, worldwide license to host and display it as needed to run the service, and you confirm you have the rights to it.
- We may remove content that violates these Terms.
10. Third-party services
Parts of TorGo rely on third parties — for example Stripe for subscription payments and Meta's WhatsApp Business platform for message delivery. Their availability is outside our control, and their terms apply to their services. We are not responsible for third-party outages, delivery failures, or changes to their platforms.
11. Availability and changes to the service
We work hard to keep TorGo available, but the service is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose and uninterrupted or error-free operation. We may add, change or remove features, and may discontinue the service with reasonable notice.
12. Limitation of liability
To the maximum extent permitted by law: (a) Sprezza LLC will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill; and (b) our total liability for all claims arising out of or relating to the service will not exceed the greater of (i) the amounts you paid us in the three (3) months before the event giving rise to the claim, and (ii) USD 100. Nothing in these Terms limits liability that cannot be limited by applicable law.
13. Indemnification
If you are a Salon, you will defend and indemnify Sprezza LLC against claims, damages and reasonable expenses (including legal fees) arising from: your content; your services and your dealings with your customers; your breach of these Terms; or marketing messages you send without the required consent.
14. Suspension and termination
- You may close your account at any time.
- We may suspend or terminate an account that materially breaches these Terms, creates legal risk, or remains unpaid — with notice where practicable.
- After closure, we will make your data available for export for 30 days on request, then delete it in line with our Privacy Policy.
- Sections that by their nature should survive (including 7, 9, 12, 13 and 16) survive termination.
15. Changes to these Terms
We may update these Terms from time to time. For material changes we will give notice via the service or your account contact details at least 14 days before they take effect. Continued use after that date means you accept the updated Terms.
16. Governing law and disputes
These Terms are governed by the laws of the State of Illinois, USA, without regard to its conflict-of-laws rules. Disputes will be resolved exclusively in the state or federal courts located in Illinois, and each party consents to their jurisdiction. This section does not deprive consumers of protections granted by mandatory law in their country of residence.
17. General
If any part of these Terms is found unenforceable, the rest remains in effect. Our not enforcing a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition or sale of assets. These Terms and the Privacy Policy are the entire agreement between us regarding the service.
